Seth A. Horvath

Seth is an associate in the firm’s Litigation Department. His practice includes commercial and employment litigation matters, as well as appellate advocacy, in state and federal courts nationwide.

Prior to joining the firm, Seth served as a judicial clerk for Justice Rita B. Garman of the Supreme Court of Illinois.

Seth’s recent experience includes:

Commercial Litigation

  • Successfully representing a credit union in a $10,000,000 dispute with the National Credit Union Administration over issues involving a liquidated credit union’s loan participation program.
  • Obtaining the dismissal of a multi-count complaint against an offshore trust management company and its officers alleging, among other things, common law fraud, civil conspiracy, securities fraud, and breach of fiduciary duty. See Dallen Wendt et al. v. Handler, Thayer & Duggan, LLC, et al., 613 F. Supp. 2d 1021 (N.D. Ill. 2009).
  • Prevailing on behalf of an international law firm in a lengthy jurisdictional dispute related to the law firm’s breach of contract claims against a municipal government.

Employment Litigation

  • Obtaining the dismissal of a multimillion dollar punitive damages claim against a major healthcare organization by a former corporate officer and subsequently achieving a successful settlement of the case.
  • Representing a contractor in an ongoing union dispute over the propriety of the union’s grievance procedures.
  • Obtaining the dismissal of charges of age, race, and disability discrimination pending against a major healthcare organization before the Illinois Department of Human Rights and the Equal Employment Opportunity Commission.
  • Successfully defending an insurance brokerage firm and its employees in a TRO proceeding seeking to restrict the scope of the employees’ customer solicitation activities.

Appellate Litigation

  • Assisting in the representation of owners of federally-subsidized affordable housing against a municipality in an appeal and oral argument before the Seventh Circuit involving, among other things, preemption under the U.S. Constitutions’ Supremacy and Property Clauses.
  • Assisting in the representation of Illinois taxpayers against former Governor Rod Blagojevich and the Department of Healthcare and Family Services in a Cook County lawsuit and the resulting appeals to the Illinois Appellate and Supreme Courts challenging as unconstitutional and unlawful a taxpayer funded health insurance program instituted by the Defendants.
  • Assisting in the expedited appeal of a state court TRO requiring a medical equipment supplier to comply with a validly terminated supply contract.
