Richard C. Himelhoch
Richard’s practice includes all aspects of intellectual property, including domestic and foreign patents, trademarks, copyrights, trade secrets and unfair competition, counseling, investigating, transactions, prosecution and litigation. He has extensive experience with U.S. patent and trademark prosecution and foreign patent prosecution and opposition, including Opposition Proceedings before the European Patent Office and the Australian Patent Office.
Richard regularly counsels clients on intellectual property procurement, strategy, maintenance and enforcement. He regularly prepares opinions, including patent and trademark clearance opinions and patentability opinions. He also drafts and prosecutes patent applications in the electrical, software and mechanical arts, as well as business method patent applications. Representative technologies include digital circuits, industrial automation systems, wireless networks and systems, welding control systems, gantry crane control systems, packaging (including metal beverage containers and corrugated boxes), composite materials (including molding and electrical resistive curing techniques), plastic pallets and containers, electrostatic coating systems, gaming and wagering systems and medical devices.
Richard has had success with Appeals to the Board of Patent Appeals and Interferences, as well as with Requests for Reexamination. He also has extensive experience with Patent and Trademark litigation and has successfully argued before the Court of Appeals for the Federal Circuit.
