Practices:
Medical Staff
Our healthcare attorneys have significant medical staff experience—some of which comes from prior experience as in-house hospital counsel. Having in-house experience provides us with unique understanding of the political issues as well as the legal issues in handling medical staff issues.
Our experience covers the gamut of practitioner-related complaints. For example, we understand how to handle the disruptive physician who is a superb clinician, or handle the physician who is impaired through substance abuse, mental health problems or aging.
We know how to navigate settlements to avoid contentious hearings. However, when a hearing proves necessary, we also know how to prepare the MEC to successfully make its case and to counsel the hearing committee to be fair and impartial.
We understand how best to protect the hospital and its medical staff by assessing all state and federal immunities. We understand regulatory requirements and the nuances of reporting problematic practitioners to federal and state authorities.
Having been through numerous credentialing disputes and hearings, we understand how best to draft medical staff bylaws, rules and regulations to clarify responsibilities and to expedite the various credentialing and hearing procedures.
We understand the legal issues surrounding closed medical staffs, exclusive contracts and economic credentialing and provide advice to meet the client’s goals while protecting its assets.
Finally, we provide education and training for medical staff leadership, hospital leadership and the hospital’s board of directors.
