401(k) Fiduciary “To-Do” List for 2011

Plan Committees will be very busy in 2011 if they intend to keep up with recent Department of Labor fiduciary mandates. There are four sets of DOL regulations going into effect on January 1, 2012, and fiduciaries must obtain significant assistance from their recordkeepers, investment advisors and ERISA counsel to meet these compliance deadlines. In addition, fee benchmarking is THE TOPIC OF THE YEAR for 2011.
Presentation Agenda
The series of ERISA fee class actions filed in 2006, followed by the market crash in 2008, has spurred the Department of Labor to issue several sets of regulations to improve the transparency of 401(k) provider fees and clarify the make-up of target date and risk-based investment funds. In addition, certain administrative fees will need to be reported as a separate line item deduction in participant statements.
Ungaretti & Harris LLP will provide their analysis of the new DOL regulations, including the new fee disclosure requirements, investment fund disclosure requirements and new content requirements for recordkeeping and investment advisory service agreements. Revenue sharing, institutional share classes, ERISA spending budgets and recordkeeping fee "leveling" will also be discussed.
JMG Financial Group, Ltd. will provide practical guidance to fiduciaries on how to identify and benchmark provider fees, including investment management, recordkeeping and investment advisory fees. This will include a discussion of benchmarking tools and techniques and maintaining due diligence review files to minimize fiduciary exposure.
An interactive question and answer session will allow attendees to "compare notes" and get practical insights on how to comply with these fiduciary mandates as the deadline for compliance approaches.
